Our services are available to every individual or organization world-wide except for people under the age of 18 years.

When placing an advertisement, you will not:

• Act in violation of any law and regulations and / or our policy as stated in these Terms of Use and Policies;
• Provide false or misleading information;
• Act in violation of any rights of third parties;
• Send messages which include spam, chain letters or pyramid schemes;
• Spread viruses or other technology that might damage the interest or property of users of Global-Energy-Marketplace.com;
• Burden the infrastructure of global-energy-marketplace.com unreasonably or disturb the proper functioning of global-energy-marketplace.com;
• Spread, copy or edit any content or personal data of third parties;
• Gather or at an other way collect data and information about others, including email addresses without their permission;

Should we, despite the above paragraph, be liable, our liability to you or third parties is limited to a maximum of (a) the total fee you paid to us during the 12 months prior to the act of which the liability is incurred, or (b) 135 US Dollars, depending on which is higher.

Personal Data

Also, you agree to receive marketing material from us, unless you notify us that you do not wish to receive such messages.

General
These Terms and other Policies, which are mentioned on Global-Energy-Marketplace.com are the entire agreement between Global-Energy-Marketplace.com and yourself, and replace all previous agreements. This agreement and other Policies are governed by Dutch law. If we do not enforce a right from the beginning, then this does not imply that we abandon this right in a later stage.

If any of these terms of use held invalid by the court, then this will not affect the other terms of use. Any dispute arising out of or in connection with these Terms and Conditions or the Agreement, including any question regarding its existence, validity or termination, that cannot be settled by negotiation of the parties and that is higher than 10.000 Euros shall be referred to and finally exclusively resolved by arbitration under the regulation of the Dutch Arbitration Institute. The decision of the arbitrator shall be final and binding upon both parties, and neither party shall seek recourse to a law court or other authorities to appeal for revisions of such decision. Disputes below the value specified in this clause shall be referred to competent court of Seller`s country, located in the Seller’s country.

Except for notices about illegal or infringing material, your notices to us must be sent by registered post addressed to Global Energy Marketplace, Celsiusweg 18E, 6662 PX Elst, The Netherlands, VAT. number NL817361789.B01 and registered by the Chamber of Commerce under number 09162478. Notices to you will be sent to you by email to the email address you gave us, or by registered post. Notifications made by registered post will be deemed to be received ten days after the date of dispatch.

We can change these Terms of Use at any time. Changes will come into force within thirty days after you purchase a bundle of advertisements or when you place an ad, depending on which event takes place earlier. Protection of intellectual property
Claimants, particularly owners of copyrights, trademarks or other rights of third parties, may refer to deals that might infringe on their rights, and send in a request for removal of these offerings. If a rightful owner mentions this to us clearly, products that are in breach of the intellectual property rights are removed by Global Energy Marketplace.

Bids are not binding
Global-Energy-Marketplace.com is not an auction-site, but an advertising site which facilitates the buying and selling of spare parts and/or parts. We are not involved in the actual transaction between the buyer and seller, so buyer and seller are responsible for their own legal actions. 
 

References to websites or services of third parties

Global-Energy-Marketplace.com could in this case perform – but not only – one or more of the following actions (whether or not after prior warning):

• Suspension of the account;
• Repeal of the Seller status (whether or not temporarily), and / or;
• Provision of (personal) data to certain third parties (such as Police, Justice and/or other ), as explained in our Privacy Policy. 

Examples of violation of the Terms of Use and/or the Policies of Global-Energy-Marketplace.com are:

• Advertisements in which no actual product is offered;
• (Paid) ads that do not meet the applicable payment terms;
• Ads in which prohibited, suspicious and/or counterfit items and/or services are offered;
• Ads that infringe on (intellectual property) rights of third parties;
• Users who approach advertisers for its own products and/or services (including spam);
• Users of whom we have strong suspicions that they are acting in breach of our Terms of Use and/or Policies.

The validity, performance and all matters relating to the interpretation and effect of these Terms and Conditions shall be construed and interpreted in accordance with the laws of the Netherlands, excluding its law on the conflict or choice of laws, provided that any provision of such law invalidating any provision of these Terms and Conditions or modifying the intent of the parties as expressed in these Terms and Conditions shall not apply. If you perform an action contrary to this arrangement, the other party can claim extrajudicial and judicial costs to a maximum of € 5.000,-.
